  1. Pr\u00e9ambule \/ Preamble<\/strong><\/li><\/ol>

    A l\u2019occasion de Chantilly Arts & Elegance Richard Mille (l\u2019\u00e9v\u00e9nement), Peter Auto, soci\u00e9t\u00e9 \u00e0 responsabilit\u00e9 limit\u00e9e au capital de 80.000 euros, dont le si\u00e8ge social est situ\u00e9 au 103 rue Lamarck \u2013 75018 Paris, immatricul\u00e9e sous le num\u00e9ro 389 751 298 RCS PARIS (PETER AUTO) propose des prestations d\u2019hospitalit\u00e9s associ\u00e9es \u00e0 l\u2019Ev\u00e9nement dans un espace (l\u2019Espace de R\u00e9ception), non ouvert au public (le Programme). Le client (le Client) a souhait\u00e9 acqu\u00e9rir les prestations d\u00e9crites dans l\u2019offre commerciale propos\u00e9e par PETER AUTO (les Prestations). A cet effet, PETER AUTO et le Client (ci-apr\u00e8s les Parties) ont d\u00e9cid\u00e9 de conclure un contrat de prestations de services d\u2019hospitalit\u00e9s (ci-apr\u00e8s le Contrat).<\/p>

    During Chantilly Arts & Elegance Richard Mille (the Event), PETER AUTO a limited liability company with a capital of 80,000 euros, whose registered office is located at 103 rue Lamarck - 75018 Paris, registered under the number 389 751 298 RCS PARIS (PETER AUTO) offers hospitality services associated with the Event in a venue (Reception Venue) closed to the public (the Program). The client (The Client) wants to acquire the services described in the sales offer by Peter Auto (The services). For this purpose PETER AUTO and the Client (hereinafter the Parties) have decided to agree a hospitality services contract (hereinafter the Contract).<\/em><\/p>

    Le Contrat est constitu\u00e9 par ordre d\u2019importance d\u00e9croissante du bon de commande (ci-apr\u00e8s la R\u00e9servation), de la facture pro-forma (la Facture), des pr\u00e9sentes conditions g\u00e9n\u00e9rales de vente de prestations de services d\u2019hospitalit\u00e9s (ci-apr\u00e8s les Conditions G\u00e9n\u00e9rales) et de l\u2019offre commerciale, qui forment un tout indissociable. En cas de contradiction entre les documents contractuels, la R\u00e9servation pr\u00e9vaudra sur les Conditions G\u00e9n\u00e9rales.<\/p>

    The Contract is made up in decreasing order of importance of an order form (hereafter the Reservation) the proforma invoice (the Invoice) the present general sales conditions of hospitality services (hereafter the General Conditions) and the Sales Offer which form an indissociable whole. In case of contradiction between the contractual documents the Reservation will prevail over the General Conditions.<\/em><\/p>

    Le Contrat dont le pr\u00e9sent Pr\u00e9ambule fait partie int\u00e9grante, r\u00e9git les relations des Parties au regard de l\u2019objet des pr\u00e9sentes \u00e0 l\u2019exclusion de tout autre document, accord \u00e9crit ou verbal ; il se substitue \u00e0 tout accord oral ou \u00e9crit \u00e9chang\u00e9 entre les Parties ant\u00e9rieurement \u00e0 la conclusion des pr\u00e9sentes et se rapportant \u00e0 son objet.<\/p>

    The Contract of which the present preamble is an integral part governs the relations between the Parties concerning the object of the presents to the exclusion of any other document, written or verbal agreement; it replaces any oral or written agreement exchanged earlier between the Parties at the conclusion of the presents and relating to its object.<\/em><\/p>

    Les Conditions G\u00e9n\u00e9rales s\u2019appliquent \u00e0 l\u2019ensemble des Prestations fournies par PETER AUTO au Client dans le cadre de l\u2019Ev\u00e8nement et lui sont adress\u00e9es, remises [ou mises \u00e0 disposition sur le site https:\/\/www.chantillyartsetelegance.com\/fr\/conditions-generales-de-vente\/ de PETER AUTO, pr\u00e9alablement \u00e0 la passation de toute commande.<\/p>

    The General Terms and Conditions apply to all Services provided by PETER AUTO to the Client in connection with the Event and are addressed to the Client, delivered [or made available on PETER AUTO's website https:\/\/www.chantillyartsetelegance.com\/fr\/conditions-generales-de-vente\/, prior to placing any order.<\/em><\/p>

    Toute R\u00e9servation du Client implique son acceptation sans condition ni r\u00e9serve des pr\u00e9sentes Conditions G\u00e9n\u00e9rales, ou sous r\u00e9serve des \u00e9ventuelles conditions particuli\u00e8res n\u00e9goci\u00e9es entres les Parties.<\/p>

    Any Booking by the Client implies its acceptance without condition or reservation of these General Conditions subject to any special conditions negotiated between the Parties.<\/em><\/p>

    Les conditions g\u00e9n\u00e9rales d\u2019achat ou tout autre document du Client sont inopposables \u00e0 PETER AUTO sans son accord pr\u00e9alable et \u00e9crit.<\/p>

    The Client's general terms and conditions of purchase or any other document of the Client are unenforceable against PETER AUTO without its prior written consent.<\/em><\/p>

    1. Achat des Prestations \/ Purchase of Services<\/em><\/strong><\/li><\/ol>

      2.1. Modalit\u00e9s d\u2019achat des Prestations \/ Terms of the purchase of services<\/p>

      La commande des Prestations se fait aupr\u00e8s de la soci\u00e9t\u00e9 PETER AUTO. Toute commande ne devient d\u00e9finitive qu\u2019apr\u00e8s acceptation \u00e9crite par PETER AUTO. Toute modification de commande du fait du Client devra faire l\u2019objet d\u2019un accord pr\u00e9alable et \u00e9crit de PETER AUTO et cette modification fera l\u2019objet, le cas \u00e9ch\u00e9ant, d\u2019une facturation suppl\u00e9mentaire ou de l\u2019\u00e9mission d\u2019un avoir.<\/p>

      The Services are ordered from PETER AUTO. Any order only becomes final after written acceptance by PETER AUTO. Any change in the order made by the Customer must be approved and written by PETER AUTO. If necessary, this change will be invoiced or a credit note issued.<\/em><\/p>

      Le client a la possibilit\u00e9 d'acqu\u00e9rir des services d'hospitalit\u00e9 directement aupr\u00e8s des \u00e9quipes de Peter Auto, que ce soit par le biais de l'e-mail ou par t\u00e9l\u00e9phone. Il peut \u00e9galement effectuer ses achats sur le site web de Peter Auto, en utilisant l'URL suivante : https:\/\/www.chantillyartsetelegance.com\/fr\/produit\/package-garden-party\/\u00a0 Cependant, il est important de noter que l'achat de services d'hospitalit\u00e9 est r\u00e9gi par les r\u00e8gles de billetterie, ce qui signifie qu'il n'y a pas de p\u00e9riode de r\u00e9tractation lorsque l'achat est effectu\u00e9 via le site internet et\/ou le bulletin d\u2019inscription.<\/p>


      The customer has the option to purchase hospitality services directly through the Peter Auto teams, either via email or by phone. They can also make their purchases on the Peter Auto website using the following URL: https:\/\/www.chantillyartsetelegance.com\/fr\/produit\/package-garden-party\/ . However, it's important to note that the purchase of hospitality services is subject to ticketing regulations, which means there is no cooling-off period when making the purchase through the e-commerce website and\/or registration form.<\/em><\/p>

      \u00a0<\/p>

      \u00a02.2. <\/strong>Prix et Modalit\u00e9s de paiement \/ <\/strong>Price and payment terms<\/strong><\/p>

      \u00a0<\/p>

      1. 2.1. Le prix des Prestations est indiqu\u00e9 en euros, par personne et avec toutes taxes comprises.<\/li><\/ol>

        The price of the services is given in euros inclusive of all taxes. <\/em><\/p>

        \u00a0<\/p>

        PETER AUTO se r\u00e9serve le droit de modifier ses prix \u00e0 tout moment mais les Prestations seront factur\u00e9es sur la base des tarifs en vigueur lors de la R\u00e9servation. En contrepartie des Prestations, le Client versera \u00e0 PETER AUTO la somme forfaitaire stipul\u00e9e sur la R\u00e9servation en euros.<\/p>

        PETER AUTO reserves itself the right to modify its prices at any moment but the Services will be invoiced at the tariffs in force at the Reservation. In return for the services the Client will pay PETER AUTO the lump sum stipulated on the Reservation in euros.<\/em><\/p>

        \u00a0<\/p>

        La totalit\u00e9 du r\u00e8glement devra parvenir d\u00e8s la r\u00e9ception de votre bulletin d\u2019inscription. Les Prestations sont r\u00e9put\u00e9es payables \u00e0 Paris. Le r\u00e8glement est r\u00e9put\u00e9 r\u00e9alis\u00e9 \u00e0 la date \u00e0 laquelle les fonds sont encaiss\u00e9s par PETER AUTO ou de son subrog\u00e9. En cas de contestation ou d\u2019ex\u00e9cution partielle du Contrat, le paiement demeure exigible sur la partie du Contrat non contest\u00e9e ou partiellement ex\u00e9cut\u00e9e.<\/p>

        Full payment must be received on receipt of your registration form. The Services are deemed to be payable in Paris. Payment is deemed to have been made on the date on which the funds are received by PETER AUTO or its subrogee. In the event of a dispute or partial performance of the Contract, payment shall remain due on the uncontested or partially performed part of the Contract.<\/em><\/p>

        \u00a0<\/p>

        Le paiement des Prestations se fait uniquement par virement sur le compte dont les coordonn\u00e9es figureront sur la Facture, par ch\u00e8que ou par Carte Bancaire.<\/p>

        Payment for the Services is made only by transfer to the bank account whose details appear on the Invoice, by cheque or by credit card. <\/em><\/p>

        \u00a0<\/p>

        2.2.2. Tout retard de paiement aux \u00e9ch\u00e9ances convenues au pr\u00e9sent article entra\u00eenera de plein droit l\u2019application d\u2019un int\u00e9r\u00eat de retard d\u2019un montant \u00e9gal au taux d\u2019int\u00e9r\u00eat appliqu\u00e9 par la BCE \u00e0 son op\u00e9ration de refinancement la plus r\u00e9cente major\u00e9 de 10 points de pourcentage \u00e0 la date d\u2019\u00e9ch\u00e9ance du d\u00e9lai de paiement applicable, m\u00eame si les sommes dues par le Client ont donn\u00e9 lieu \u00e0 l\u2019\u00e9mission de traites d\u00e9j\u00e0 mises en circulation. En cas de retard de paiement, PETER AUTO sera en droit d\u2019exiger du Client le paiement d\u2019une indemnit\u00e9 forfaitaire pour frais de recouvrement d\u2019un montant de 40 euros, en sus des indemnit\u00e9s de retard, conform\u00e9ment \u00e0 l\u2019article L. 441-10 du Code de commerce.<\/p>

        En cas de retard de paiement, PETER AUTO se r\u00e9serve, en outre, la facult\u00e9 (i) de suspendre ou d\u2019annuler de plein droit et sans mise en demeure pr\u00e9alable, en totalit\u00e9 ou partiellement, l\u2019ex\u00e9cution des Prestations sauf \u00e0 ce que le Client puisse \u00e9tablir l\u2019existence d\u2019un cas de force majeure, sans pr\u00e9judice de toute indemnisations qui pourraient \u00eatre r\u00e9clam\u00e9es par PETER AUTO en cas d\u2019inex\u00e9cution partielle ou totale des autres stipulations des pr\u00e9sentes Conditions G\u00e9n\u00e9rales.<\/p>


        Any delay in payment on the due dates agreed in this Article shall automatically give rise to the application of default interest of an amount equal to the interest rate applied by the ECB to its most recent refinancing operation plus 10 percentage points on the due date of the applicable payment period, even if the sums due by the Client have given rise to the issue of drafts already put into circulation. In the event of late payment, PETER AUTO shall be entitled to demand from the Client the payment of a fixed compensation for recovery costs in the amount of 40 euros, in addition to the late payment compensation, in accordance with Article L. 441-10 of the French Commercial Code. In the event of late payment, PETER AUTO also reserves the right (i) to automatically suspend or cancel the performance of the Services in whole or in part without prior notice, except where the Client can establish the existence of a case of force majeure, without prejudice to any compensation that may be claimed by PETER AUTO in the event of partial or total non-compliance with the other provisions of these General Terms and Conditions.<\/em><\/p>

        2.3. Engagement \/ Commitment<\/em><\/strong><\/p>

        2.3.1. Le Client d\u00e9clare avoir pris connaissance et accept\u00e9 les pr\u00e9sentes Conditions G\u00e9n\u00e9rales pr\u00e9alablement \u00e0 la passation de toute commande.<\/p>

        The Client states having read and accepts the present General Conditions prior to the validation of the Reservation before the payment.<\/em><\/p>

        2.3.2. Tout engagement du Client est ferme et d\u00e9finitif et ne peut faire l'objet de remboursement pour quelque motif que ce soit. Le Client ne pourra revendiquer une quelconque compensation ou indemnit\u00e9 financi\u00e8re dans le cas o\u00f9, pour quelque raison que ce soit, il ne ferait pas usage, en tout ou partie, des Prestations. En cas de d\u00e9sistement, refus, ou annulation de la part du Client, PETER AUTO sera lib\u00e9r\u00e9 de toute obligation envers le Client et celui-ci ne pourra pr\u00e9tendre ni au report des Prestations \u00e0 une autre date, ni au remboursement des sommes d\u00e9j\u00e0 vers\u00e9es et conserv\u00e9es par PETER AUTO \u00e0 titre d\u2019indemnit\u00e9 de r\u00e9siliation contractuelle irr\u00e9ductible.<\/p>

        Any commitment by the Client is binding and irrevocable and cannot be reimbursed for any reason whatsoever.
        The Client cannot claim any compensation or financial indemnity in the case where, for any reason whatsoever, the Client does not use all or part of the Services. In the event of withdrawal, refusal or cancellation by the Client, PETER AUTO shall be released from any obligation towards the Client and the latter shall not be entitled to postpone the Services to another date, nor to reimbursement of sums already paid and retained by PETER AUTO as irreducible contractual termination compensation.<\/em><\/p>

        \u00a0<\/p>

        1. Obligations de PETER AUTO \/ PETER AUTO\u2019s obligations<\/strong><\/li><\/ol>

          \u00a0<\/p>

          PETER AUTO s\u2019engage \u00e0 fournir au Client les Prestations directement ou par l\u2019interm\u00e9diaire de prestataires tiers auxquels elle aura pu confier tout ou partie des Prestations.<\/p>

          PETER AUTO commits to supplying the client with the Services either directly or through third party providers to whom it has entrusted all or part of the Services.<\/em><\/p>

          1. Obligations du Client \/ <\/strong>Client\u2019s obligations<\/strong><\/li><\/ol>

            4.1. Finalit\u00e9 \/ Purpose<\/em><\/p>

            Les Prestations en vente par PETER AUTO sont destin\u00e9es aux clients, prospects, salari\u00e9s, pr\u00e9pos\u00e9, agents, etc., personnes physiques, du Client (ci-apr\u00e8s les \u00ab Personnes \u00bb) pour leur usage et consommation personnels.
            The Services sold by PETER AUTO are for clients, prospects, employees, representatives, agents, natural persons of the Client\u2019s (hereafter the Persons) for their personal use and consumption.<\/em><\/p>

            Le Client s\u2019engage \u00e0 ne pas c\u00e9der, de quelque mani\u00e8re et \u00e0 quelque fin que ce soit, en tout ou partie, les Prestations objets du Contrat.<\/p>

            The Client commits not to cede in any way whatsoever and to any end whatsoever either in whole or in part the Services that are the object of the Contract.<\/em><\/p>

            4.2. Acc\u00e8s \u00e0 l\u2019Espace de r\u00e9ception \/ Access to the reception venue<\/em><\/p>

            Aucune invitation \u00e9mise par le Client ne peut \u00eatre consid\u00e9r\u00e9e comme un acc\u00e8s valable \u00e0 l\u2019Ev\u00e9nement. Seules les personnes ayant un accr\u00e9ditif d\u00e9livr\u00e9 par PETER AUTO pourront acc\u00e9der \u00e0 l\u2019Espace de R\u00e9ception.
            No invitation handed out by the Client can be considered as a valid access to the Event. Only people having an accreditation issued by PETER AUTO can access the Reception Venue.<\/em><\/p>

            PETER AUTO se r\u00e9serve le droit de refuser l\u2019acc\u00e8s \u00e0 l\u2019Espace de R\u00e9ception ou d\u2019expulser de l\u2019Espace de R\u00e9ception, toute personne dont le comportement serait de nature \u00e0 g\u00eaner les autres Clients ou \u00e0 perturber la bonne tenue du Programme ou de l\u2019Ev\u00e9nement.
            PETER AUTO reserves itself the right to refuse access to the Reception Venue and to expel from the Reception Venue anybody whose behaviour bothers the others or upsets the good performance of the Programme or of the Event. <\/em><\/p>

            4.3. Communication \u2013 visibilit\u00e9 \/ Communications <\/em>\u2013 <\/em>visibility<\/em><\/p>

            4.3.1. Le Client ainsi que les Personnes acceptent d'\u00eatre film\u00e9s et\/ou photographi\u00e9s et que leur image ainsi reproduite puisse \u00eatre librement exploit\u00e9e par PETER AUTO ou ses ayants-droits ou ayants-cause lors de la diffusion et la promotion du Programme et de l'Ev\u00e9nement.<\/p>

            The Client and the people accompanying him accept to be filmed and\/or photographed and that their image so produced can be freely exploited by PETER AUTO or its beneficiaries or dependents during the diffusion and promotion of the Programme or of the Event.<\/em><\/p>

            4.3.2. Sauf autorisation expresse consentie par PETER AUTO au Client, par contrat s\u00e9par\u00e9, et dans le strict cadre de cette autorisation, Le Client veillera \u00e0 ce que lui-m\u00eame et les Personnes respectent l\u2019interdiction d\u2019exploitation, sous toute forme et pour quelque usage que ce soit hors le strict cadre de l\u2019exploitation au sein du cercle de famille, de photos ou films repr\u00e9sentant en tout ou partie le Programme ou l'Ev\u00e9nement.<\/p>

            Unless express authorisation is given by PETER AUTO to the client in a separate contract and in the strict context of this authorisation, the Client will ensure that himself and the Persons respect the interdiction to exploit in any form whatsoever, and for any use whatsoever outside the strict context of the exploitation within the family circle, photos or films representing all or part of the Programme or the Event.<\/em><\/p>

            4.3.3. Le Client s\u2019oblige \u00e0 ne faire aucune d\u00e9claration susceptible de porter atteinte \u00e0 l\u2019image de PETER AUTO, de l\u2019Ev\u00e9nement ou du Programme. Le Client s\u2019oblige \u00e0 respecter une stricte confidentialit\u00e9 et s'interdit de divulguer \u00e0 quiconque, pour quelque cause que ce soit, toutes les informations dont elle aurait pu avoir connaissance \u00e0 l'occasion des pr\u00e9sentes relatives \u00e0 l\u2019\u00e9v\u00e9nement ou, plus g\u00e9n\u00e9ralement, \u00e0 PETER AUTO.<\/p>

            The client commits not to make any statements that may tarnish the image of PETER AUTO, the Event or the Programme. The Client commits to respecting absolute confidentiality and refrains from divulging to anybody for any reason whatsoever any information that he may have learned through the presents relating to the event or more generally to PETER AUTO.<\/em><\/p>

            4.3.4. Toute r\u00e9f\u00e9rence au Programme et \u00e0 l\u2019Ev\u00e9nement ainsi que toute utilisation par Le Client du logo de l\u2019Ev\u00e9nement et\/ou le cas \u00e9ch\u00e9ant du Programme ou de tout autre signe distinctif relatif \u00e0 L\u2019Ev\u00e9nement ou \u00e0 PETER AUTO ainsi que toute utilisation de termes tels que \"Fournisseur\", \"Partenaire\", \"Sponsor\", \"Parrain\" de l\u2019Ev\u00e9nement ou du Programme est strictement interdite.
            Il est \u00e9galement interdit de revendre son Package VIP \u00e0 autrui.<\/p>

            Any reference to the Programme and the Event as well as any use by the Client of the logo of the Event and\/or if applicable when needed of the Programme or any other distinctive sign related to the Event or PETER AUTO as well as any use of terms such as \u201cSupplier,\u201d \u201cPartner,\u201d \u201cSponsor,\u201d \u201cGodfather,\u201d of the Event or of the Programme is strictly forbidden.
            It is also forbidden to resell your VIP Package to others.<\/em><\/p>

            1. INFORMATIQUE & LIBERT\u00c9 \/ DATABASE AND PRIVACY LAWS<\/strong><\/li><\/ol>


              <\/strong>Les informations recueillies sur ce formulaire sont enregistr\u00e9es dans un fichier informatis\u00e9 par PETER AUTO dans le but de vous permettre de vous inscrire \u00e0 cet \u00e9v\u00e9nement. Vos donn\u00e9es sont conserv\u00e9es pendant la dur\u00e9e de la mise en place de l\u2019\u00e9v\u00e8nement et sont destin\u00e9es \u00e0 r\u00e9pondre aux demandes d\u2019informations, proposer des offres commerciales, g\u00e9rer l\u2019inscription et la facturation des prestations et pour la gestion de la relation clients et prospects. Vos donn\u00e9es sont conserv\u00e9es pendant 3 ans \u00e0 compter de votre derni\u00e8re activit\u00e9 (participation \u00e0 nos \u00e9v\u00e8nement, achat plateforme ou sur place\u2026) et interactions avec nos services. Ces donn\u00e9es sont destin\u00e9es aux services Marketing, Communication et Commercial. Conform\u00e9ment aux lois \"Informatique & Libert\u00e9\" et \"RGPD\", vous pouvez exercer vos droits d\u2019acc\u00e8s aux donn\u00e9es, de rectification ou d\u2019opposition en contactant info@peter.fr<\/a><\/p>

              The information on these forms are registered in a computerised file created by PETER AUTO to enable you to enter for this event. Your data are kept for the duration of the event and are intended to respond to requests for information, to propose commercial offers, to manage the registration and billing of services and to manage the relationship of customers and prospects. Your data are kept for 3 years from your last activity (participation in our events, platform or onsite purchase\u2026) and interactions with our services. This data are intended for Marketing, Communication and Commercial services. In accordance with the Information and Freedom laws and RGPD you can exercise your rights to access data for rectification or opposition by contacting info@peter.fr<\/em><\/p>

              \u00a0<\/strong><\/p>

              1. Responsabilit\u00e9 du Client et Assurances \/ <\/strong>Clien<\/em><\/strong>t\u2019<\/em><\/strong>s responsibility and insurance<\/em><\/strong><\/li><\/ol>

                Le Client sera responsable, pendant toute la dur\u00e9e du Contrat, de tous ses faits ou dans l\u2019enceinte de l\u2019Ev\u00e9nement.
                The Client will be responsible throughout the duration of the contract for all his acts within the Event\u2019s enclosure.<\/em><\/p>

                Le Client est responsable de tout d\u00e9g\u00e2t, dommage, d\u00e9gradation, d\u00e9t\u00e9rioration de l\u2019Espace de R\u00e9ception qui serait constat\u00e9 par PETER AUTO post\u00e9rieurement \u00e0 sa mise \u00e0 disposition au Client. En cons\u00e9quence, Le Client s\u2019engage \u00e0 rembourser \u00e0 PETER AUTO \u00e0 premi\u00e8re demande et sur simple pr\u00e9sentation des justificatifs, tous les frais que celle-ci aura d\u00fb engager pour la remise en \u00e9tat de l\u2019Espace de R\u00e9ception.<\/p>

                The Client is responsible for any damage, degradation, or deterioration of the Reception Venue noted by PETER AUTO after it has been put at the Client\u2019s disposal. Thus, the Client commits to reimbursing PETER AUTO on first demand and on the simple presentations of justifications all the expenses that the latter has had to commit for repairs to the Reception Venue.<\/em><\/p>

                Le Client devra, sans d\u00e9lai, informer PETER AUTO de tout incident, dommage corporel et\/ou mat\u00e9riel quel qu\u2019il soit, survenant dans l\u2019Espace de R\u00e9ception.<\/p>

                The Client must immediately inform PETER AUTO of any incident, bodily or material damage whatsoever in the Reception Venue.<\/em><\/p>

                En outre, Le Client s\u2019engage \u00e0 souscrire, \u00e0 ses frais, et \u00e0 maintenir en vigueur pendant toute la dur\u00e9e du Contrat, une assurance couvrant sa responsabilit\u00e9 civile pour tous types de dommages, corporels, mat\u00e9riels et immat\u00e9riels, directs ou indirects caus\u00e9s de son fait ou du fait des Personnes et \u00e0 en justifier sur simple demande, \u00e0 PETER AUTO.
                In addition, the Client commits to contracting an insurance policy at his own expense that remains in force for the duration of the contract covering his civil responsibilities for all kinds of direct or indirect bodily, material and immaterial damages caused by himself of by persons and justify it on a simple request to PETER AUTO.<\/em><\/p>

                1. R\u00e9siliation \/ <\/strong>Termination<\/em><\/strong><\/li><\/ol>

                  En cas de manquement du Client ou des Personnes \u00e0 l\u2019une des quelconques obligations pr\u00e9vues dans le contrat pr\u00e9sent, le Contrat pourra \u00eatre r\u00e9sili\u00e9 de plein droit sans formalit\u00e9 judiciaire, par PETER AUTO, apr\u00e8s une mise en demeure afin d\u2019y rem\u00e9dier, notifi\u00e9e au Client par tous moyens probants et rest\u00e9e infructueuse ; et ce sans pr\u00e9judice pour PETER AUTO de toute demande de dommages et int\u00e9r\u00eats. Cette mise en demeure pourra \u00eatre de l\u2019ordre de l\u2019heure suivant la nature de la d\u00e9faillance ou de la violation.<\/p>

                  In case of failure by the Client or Persons to fulfil any of the obligations laid down in the presents, the Contract can be automatically terminated without any judicial formalities by PETER AUTO after formal notice to remedy it, sent to the Client by all appropriate means remains unsuccessful without prejudice for PETER AUTO to demand damages and interest. This formal notice can be immediate depending on the nature of the failure or breach.<\/em><\/p>

                  1. Responsabilit\u00e9 \/ Responsability<\/strong><\/li><\/ol>

                    La responsabilit\u00e9 de PETER AUTO est limit\u00e9e \u00e0 la r\u00e9paration des dommages mat\u00e9riels directs caus\u00e9s au Client qui r\u00e9sulteraient d\u2019une mauvaise ex\u00e9cution de ses obligations contractuelles.<\/p>

                    PETER AUTO's liability is limited to compensation for direct material damage caused to the Client as a result of improper performance of its contractual obligations.<\/em><\/p>

                    Sauf en cas de faute lourde ou de dol, PETER AUTO ne sera donc pas tenu de r\u00e9parer :<\/p>

                    Except in the event of gross negligence or fraud, PETER AUTO will therefore not be required to repair:<\/em><\/p>

                    The harmful consequences of the Client's or third parties' mistakes relating to the performance of the contract<\/em><\/p>

                    En tout \u00e9tat de cause sauf stipulations contractuelles contraires, la responsabilit\u00e9 cumul\u00e9e de <\/strong>PETER AUTO est plafonn\u00e9e aux sommes encaiss\u00e9es au titre de la fourniture de la Prestation au jour de la r\u00e9clamation.<\/strong><\/p>

                    In any event, unless otherwise stipulated in the contract, PETER AUTO's cumulative liability is limited to the sums received for the provision of the Service on the day of the claim.<\/em><\/strong><\/p>

                    La participation des enfants mineurs est conditionnelle \u00e0 leur accompagnement par un adulte pendant toute la dur\u00e9e de l'\u00e9v\u00e9nement. L'adulte accompagnant assume la responsabilit\u00e9 de l'enfant et se porte garant en cas de dommages \u00e9ventuels.<\/strong><\/p>

                    The participation of minors is contingent upon their accompaniment by an adult throughout the entire event. The accompanying adult assumes responsibility for the child and vouches for any potential damages.<\/em><\/strong><\/p>

                    1. Force Majeure<\/strong><\/li><\/ol>

                      Les Parties conviennent express\u00e9ment que la responsabilit\u00e9 de PETER AUTO ne saurait \u00eatre recherch\u00e9e si l'Ev\u00e9nement et\/ou le Programme devait \u00eatre annul\u00e9 ou interrompu pour un cas de force majeure.<\/p>

                      The parties agree that PETER AUTO cannot be held liable if the Event and\/or Programme have to be cancelled or interrupted for reasons of force majeure.<\/p>

                      En cas de non-participation du fait du client ou des conditions climatiques, le montant de l\u2019inscription sera acquis par PETER AUTO, sans que cela ne puisse ouvrir un droit \u00e0 une quelconque indemnisation ou \u00e0 un remboursement m\u00eame partiel du prix pay\u00e9. Concernant la pand\u00e9mie de COVID-19 connue \u00e0 ce jour mais dont les d\u00e9veloppements quant \u00e0 l\u2019\u00e9tendue, la dur\u00e9e et les mesures gouvernementales s\u2019y rapportant, sont \u00e0 ce jour impr\u00e9visibles pays par pays, les parties conviennent que tout \u00e9v\u00e8nement ou d\u00e9cision gouvernementales li\u00e9s \u00e0 cette pand\u00e9mie et entravant la tenue de la manifestation telle que pr\u00e9vue aux pr\u00e9sentes, sera consid\u00e9r\u00e9 comme un cas de force majeure. En cons\u00e9quence, elles conviennent que si l\u2019emp\u00eachement est temporaire, l\u2019ex\u00e9cution de l\u2019obligation sera suspendue, \u00e0 moins que le retard qui en r\u00e9sulterait ne justifie la r\u00e9solution du contrat. Si l\u2019emp\u00eachement est d\u00e9finitif, le contrat sera r\u00e9solu de plein droit et les parties seront lib\u00e9r\u00e9es de leurs obligations.
                      In case of non-participation due to the client or weather conditions, the registration fee will be paid to SAVH, without this giving rise to any right to compensation or a refund, even partial, of the price paid. Regarding the COVID-19 pandemic known to date but whose developments as to the extent, duration and related government measures are to date unpredictable country by country, the parties agree that any government event or decision related to this pandemic and hindering the holding of the event as provided for herein, will be considered a case of force majeure. Accordingly, they agree that if the impediment is temporary, performance of the obligation will be suspended, unless the resulting delay justifies termination of the contract. If the impediment is final, the contract will be terminated automatically, and the parties will be released from their obligations.<\/em><\/p>

                      Le Client reconna\u00eet que PETER AUTO ne sera pas tenu de lui rembourser la somme stipul\u00e9e sur la Facture ni lui verser une quelconque indemnit\u00e9 du fait de l'interruption ou de l\u2019annulation totale de l'Ev\u00e9nement et\/ou du Programme et renonce d\u2019ores et d\u00e9j\u00e0 \u00e0 toute action en responsabilit\u00e9 \u00e0 l\u2019encontre de PETER AUTO aux fins d\u2019obtenir des dommages-int\u00e9r\u00eats pour ces motifs.
                      The Client acknowledges that PETER AUTO cannot be obliged to reimburse it the amount on the Invoice or pay it any indemnities because of the interruption or cancellation of the Event and\/or Programme and renounces any legal proceedings for PETER AUTO\u2019s responsibility to obtain damages-interests for these reasons.<\/em><\/p>

                      1. Intuitu personae <\/strong><\/li><\/ol>

                        \u00a0<\/p>

                        Le pr\u00e9sent Contrat est conclu intuitu personae entre les Parties. Les droits et obligations du Client ne sauraient \u00eatre c\u00e9d\u00e9s en tout ou partie, d\u00e9l\u00e9gu\u00e9s ou transf\u00e9r\u00e9s \u00e0 un tiers, par quelque moyen que ce soit, sans le consentement \u00e9crit, expr\u00e8s et pr\u00e9alable de PETER AUTO.<\/p>

                        The present contract is concluded Intuitu personae between the Parties. The rights and obligations of the Client cannot be ceded in part or in whole, delegated, or transferred to a third party by any means whatsoever without the previous written express agreement of PETER AUTO.<\/em><\/p>

                        1. Loi applicable et comp\u00e9tence juridictionnelle \/ <\/strong>Law applicable and jurisdictional competence<\/em><\/strong><\/li><\/ol>

                          Le pr\u00e9sent contrat a \u00e9t\u00e9 r\u00e9dig\u00e9 en langue fran\u00e7aise qui sera consid\u00e9r\u00e9e en toute hypoth\u00e8se comme la langue unique du contrat. Il est r\u00e9gi en toutes ses dispositions par le droit fran\u00e7ais.<\/p>

                          The present contract has been drawn up in the French language which will be considered in all hypotheses as the unique language of the contract. It is governed by French law in all its dispositions.<\/em><\/p>

                          Tout litige concernant sa validit\u00e9, son interpr\u00e9tation, son ex\u00e9cution et\/ou sa r\u00e9siliation et\/ou son expiration, sera soumis \u00e0 la comp\u00e9tence exclusive des juridictions comp\u00e9tentes du ressort de la cour d\u2019appel de Paris, nonobstant toute demande incidente et\/ou garantie ou de pluralit\u00e9 de d\u00e9fendeurs.<\/p>

                          Any litigation concerning its validity, interpretation, its execution and\/or expiry will be submitted to the exclusive competence of the appropriate jurisdictions of the Paris Court of Appeal nonobstant any request instance and\/or guarantee or plurality of the defendants.<\/em><\/p>

                            Aucun fait de tol\u00e9rance par PETER AUTO, m\u00eame r\u00e9p\u00e9t\u00e9, ne saurait constituer une renonciation de celle-ci \u00e0 l\u2019une quelconque des dispositions du pr\u00e9sent Contrat.<\/p>

                            No tolerance by PETER AUTO even if repeated will constitute a renunciation by it of any of the dispositions of the present contract.<\/em><\/p>

                            Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales et les \u00e9ventuelles conditions particuli\u00e8res n\u00e9goci\u00e9es entre les Parties constituent l\u2019ensemble des engagements pris par les Parties. Elles annulent et remplacent tous les accords verbaux et \u00e9crits ant\u00e9rieurs \u00e0 leur diffusion ou pouvant se rapporter \u00e0 leur objet.<\/p>

                            These General Conditions and any special conditions negotiated between the Parties constitute all the commitments undertaken by the Parties. They cancel and replace all verbal and written agreements prior to their distribution or that may be relevant to their purpose.<\/em><\/p>

                            En cas de nullit\u00e9 de l\u2019une quelconque des dispositions du pr\u00e9sent Contrat, les Parties rechercheront de bonne foi des dispositions \u00e9quivalentes valables. En tout \u00e9tat de cause, les autres conditions et dispositions du Contrat demeureront en vigueur.
                            In case of invalidity of any of the dispositions of the present Contract the parties will search for valid equivalent dispositions in good faith. In any case, the other conditions and dispositions of the Contract will remain valid.<\/em><\/p>
